General Terms and Conditions

These Terms and Conditions represent an agreement by and between Stacy Gray, doing business as Affinity Travel, hereinafter referred to as “Agent," and any person(s) who have requested the services of Stacy Gray and/or will be a booked traveler of a travel arrangement which has been arranged by Stacy Gray, whom hereinafter will be referred to as “Client/Traveler."

By acceptance of a booking reservation, airfare ticket, hotel accommodation, cruise line ticket, and/or any other travel arrangement which has been arranged by the Agent, each Client/Traveler agrees to these Terms and Conditions for him/herself as well as for his/her traveling minor(s) and/or other traveling companions. It is the responsibility of the paying Client/Traveler to provide all other traveling companions with these Terms and Conditions that apply to the acceptance of their booking reservation(s).

Risk of Travel and Release of Liability – Client/Traveler acknowledges and understands that the Agent offers retail travel booking services to clients in which travel services and accommodations are provided by separate and independent suppliers of travel. The Agent does not operate, control, or otherwise provide the services of the independent travel suppliers. As such, the Client/Traveler agrees that the Agent acts only as an agent for the Client/Traveler(s) in acquiring transportation, cruise tickets, hotel accommodations, theme park tickets, excursions or activities, sightseeing, and other privileges or services for the Client/Traveler(s) benefit, and on the express condition that the Agent shall not be responsible for any damages, loss, accident, injury, death, delay, defect, monetary loss, omission or irregularity which may occur or be occasioned, whether by reason of any act of God or force majeure, unsafe conditions, terrorism, war or threats of war, riots, civil unrest, defects  in machinery or vehicles, health hazards, weather hazards, wildlife, environmental issues of the destination, pandemics, illness, negligence or default of the Client/Traveler and/or his/her traveling companions, negligence or default of any company or person engaged in or responsible for carrying out any of the arrangements, or otherwise in connection therewith. The Client/Traveler also acknowledges and understands that travel arrangements may be altered, delayed, interrupted, and/or canceled by the travel supplier, a government entity, or third party for reasons such as COVID-19 or other pandemic, extreme weather, government restrictions, national or international security, as well as other reasons that are not reasonably foreseeable. The Client/Traveler understands and agrees that the Agent has no control over such situations and, therefore, will not be held liable.  Agent has no special knowledge of dangers, unsafe conditions, health hazards, weather hazards, or the suitability for disabled persons during travel or at specific destinations.  For information concerning possible dangers at the travel destinations, the Client/Traveler should visit www.travel.state.gov and search the travel warning section specific to the city, state, and/or country they will be traveling to. It is also recommended for the Client/Traveler to visit www.cdc.gov/travel for any medical or health advisories specific to their travel destination. The Client/Traveler assumes all risks associated with the travel itinerary and travel arrangements for him/herself as well as for his/her traveling minor(s) and/or other traveling companions.

Booking Process, Travel Supplier Terms and Conditions, Refunds, and Cancelation Policies – The Client/Traveler understands and agrees that by requesting the services of the Agent, he/she is authorizing the Agent to sign documents necessary for booking the requested travel arrangements on his/her behalf and on the behalf of any traveling companions.  The paying Client/Traveler understands that in order for Agent to book the requested travel arrangements, the paying Client/Traveler is authorizing the use of his/her credit card for the transactions and all payments will be made directly to the travel supplier(s). Client/Traveler understands that the charges to his/her credit card statement will reflect the name of the travel supplier(s) used in connection with the booking and he/she agrees not to dispute any such charges so long as the charges correspond to the booking request, quote, and/or trip invoice. All prices and rates are in U.S. Dollars and all payments made toward the booking must be made in U.S. Dollars. The Client/Traveler acknowledges that many travel deposits are non-refundable. The Client/Traveler understands and agrees that should he/she choose to change or cancel the travel plans or fail to pay the final payment(s) of the booking(s), the Client/Traveler may incur cancelation fees and/or non-refundable deposits or payments. The Client/Traveler acknowledges and understands that it is his/her responsibility to review and abide by the terms and conditions and the cancelation policies of each travel supplier; and agrees that these such policies will govern all rights and remedies, including the right to receive a refund, in such an event as altered, delayed, interrupted, and/or changed or canceled travel arrangements.  The Client/Traveler is aware that airline ticket(s) may be subject to the loss of some (or all) of the fare if the Client/Traveler elects to change or cancel the reservation. The Client/Traveler further understands that additional fees may be assessed if changes are requested after a deposit has been made to any travel supplier. In addition, the Client/Traveler agrees to review and abide by all terms and conditions of the travel supplier associated with any additional items that he/she may choose to add to the itinerary from this point forward.

Travel Protection Insurance - Travel protection insurance is strongly recommended to protect a travel investment and minimize the considerable financial risks of traveling: accidents, illness, interrupted or canceled travel arrangements, lost baggage, theft, medical emergencies, emergency evacuation, and more.  Adding travel insurance to a vacation plan is relatively inexpensive and will help provide peace of mind and protection if the unexpected happens during a trip.  A Client/Traveler’s regular medical insurance may not provide coverage outside of the United States or in certain destinations and it is the Client/Traveler’s responsibility to determine what is and is not covered by their insurance. A travel insurance quote will be provided to the paying Client/Traveler as permitted by the Client/Traveler's state of residence, and he/she will have the option to accept or decline travel protection insurance.  If the Client/Traveler elects to purchase travel insurance, the terms of such policy will determine whether, and to what extent, any financial loss may be covered.  It is the Client/Traveler’s responsibility to review the terms and conditions of any travel protection plan prior to accepting.  Actual coverage and details should be discussed directly with the travel insurance company.  If any Client/Traveler wishes to inquire about and/or purchase their own travel insurance or additional travel insurance, he/she must make that request in writing within one week of the initial booking deposit.

Travel Documentation – The Client/Traveler agrees to adhere to all travel documentation protocols, entry requirements for the travel destination(s), as well as the requirements for returning to the United States as set forth by the governing authorities. The Client/Traveler further acknowledges that travel protocols are subject to change at any time without notice, at no fault of the Agent. It is the responsibility of each Client/Traveler to ensure that they have all the proper documents for their travel destinations and returning entry to the United States. U.S. citizens traveling to any destination outside of the United States will be required to present a valid U.S. passport. Passports must be valid for at least 6 months past the final day of the trip.  All names on documents must match the legal names on each Client/Traveler’s passport, or if traveling within the United States, all names on documents must match the legal names on each Client/Traveler’s government-issued I.D. Though some cruises that begin and return to the same U.S. port may only require a state-issued birth certificate with raised seal and a government-issued photo ID, it is recommended to always travel with a passport in case of an emergency or missed ship sailing; in which case, a Client/Traveler may need to have a passport for returning to the United States. It is the Client/Traveler’s responsibility to check the State Department website at  https://travel.state.gov for verification of travel document requirements. Certain criminal offenses on a Client/Traveler’s record may result in denied entry to some foreign countries. It is the Client/Traveler’s responsibility to determine his/her eligibility for entering any foreign country. Some countries require a visa for transit or entry. Client/Traveler understands that failure to comply with any travel regulations and/or travel document requirements may result in denied boarding, denied entry, and/or government-imposed fines. Non-U.S. citizens may be subject to additional travel requirements and should check their own countries government requirements as well as the nearest consulate or embassy of the destination they are traveling to for all travel information. Agent has no knowledge of, nor will advise on, the travel requirements pertaining to a non-U.S. citizen. 

COVID-19 Risk and Health Protocols – The Client/Traveler agrees and understands that there may be COVID-19 and/or other health risks associated with the travel arrangements and that the Agent assumes no such liability for these risks. COVID-19 testing, health screenings, vaccinations, quarantines, and/or face coverings may be required for the travel arrangements. It is the Client/Traveler’s responsibility to check for any requirements and protocols that pertain to the method and destinations of travel on the itinerary. Client/Traveler agrees that failure to comply with any COVID-19 and/or health protocols may result in denied boarding, denied entry, and/or government-imposed fines. Client/Traveler agrees and understands that in the event of an illness during travel, the Client/Traveler and all traveling companions will be subject to the rules and protocols of the airline, cruise line, hotel, and/or any other travel supplier associated with the itinerary, and further understands and agrees that the Agent has no control over such situation.

By acceptance of a booking reservation, airfare ticket, hotel accommodation, cruise line ticket, group contract, and/or any other travel arrangement which has been arranged by the Agent, the Client/Traveler agrees to release, discharge, covenant not to sue, and hold harmless the Agent, Stacy Gray, doing business as Affinity Travel, and any owner(s), officer(s), agent(s), and successor(s), from any damages, loss, accident, injury, death, delay, defect, monetary loss, omission and/or irregularity that may occur during travel and/or as a result of the travel arrangements. Client/Traveler acknowledges that he/she has reviewed and understands the entirety of these terms and conditions.  Client/Traveler further agrees to review and abide by each travel supplier’s terms and conditions as related to the travel itinerary and agrees to review all travel documents and itinerary for accuracy.
